1. Acceptance of Terms
By installing and using AI 3000 PRO on your Shopify store, you ("Merchant," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not install or use the application. These terms constitute a legally binding agreement between you and AI 3000 PRO.
2. Service Description
AI 3000 PRO is an AI-powered customer support chatbot application for Shopify stores. The service provides automated responses to customer inquiries based on your store's product catalog, policies, and order information.
Service is Provided "As Is": We make no guarantees regarding:
• Service uptime or availability (target: 99% uptime, but not guaranteed)
• Accuracy of AI-generated responses
• The AI's ability to handle all customer inquiries correctly
• Compatibility with all Shopify themes or third-party apps
3. Shopify Requirements & Compliance
By using AI 3000 PRO, you acknowledge that:
• You have a valid Shopify store and active Shopify subscription
• You grant AI 3000 PRO the necessary API permissions to access your store data
• You comply with Shopify's Terms of Service and Acceptable Use Policy
• You are responsible for ensuring AI-generated responses comply with Shopify's policies
4. Billing & Subscription Terms
Payment: Subscription fees are billed through Shopify's billing system. By subscribing, you authorize Shopify to charge your payment method on file.
Pricing: Current pricing is displayed during installation and in the Shopify App Store. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Cancellation: You may cancel your subscription at any time through the Shopify admin. Upon cancellation:
• You will retain access until the end of your current billing period
• No refunds will be provided for partial billing periods
• Your data will be deleted within 30 days unless you request immediate deletion
Free Trials: If a free trial is offered, you will not be charged until the trial period ends. You may cancel during the trial without charge.
5. User Responsibilities
As a merchant using AI 3000 PRO, you are responsible for:
• Monitoring AI Responses: Regularly reviewing chatbot conversations to ensure accuracy and appropriateness
• Legal Compliance: Ensuring all AI-generated responses comply with applicable laws, including consumer protection, privacy, and advertising regulations
• Customer Service Standards: The AI chatbot supplements but does not replace your obligation to provide quality customer service
• Accurate Store Data: Maintaining accurate product information, pricing, and policies in your Shopify store
• Customer Disputes: Handling any customer complaints or disputes arising from chatbot interactions
6. Prohibited Uses
You may not use AI 3000 PRO to:
• Engage in illegal activities or sell prohibited products
• Distribute harmful, fraudulent, or misleading content
• Violate intellectual property rights of others
• Harass, abuse, or harm others
• Attempt to reverse engineer, hack, or compromise the service
• Resell or redistribute the service without authorization
• Use the service in a manner that violates Shopify's policies or terms
7. API Usage & Rate Limits
AI 3000 PRO operates within Shopify's API rate limits. Excessive usage that impacts service performance may result in temporary throttling or suspension. We reserve the right to implement fair usage policies to ensure service quality for all users.
8. Intellectual Property
AI 3000 PRO Ownership: We retain all rights, title, and interest in the AI 3000 PRO application, including all intellectual property rights.
Your Content: You retain ownership of your store data, product information, and customer data. By using the service, you grant us a limited license to access and process this data solely to provide the chatbot service.
AI-Generated Content: Responses generated by the AI chatbot are provided for your use, but we make no warranties regarding their accuracy or suitability.
9. Limitation of Liability
NO LIABILITY FOR INDIRECT DAMAGES: To the maximum extent permitted by law, AI 3000 PRO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Lost profits or revenue
• Loss of customers or business opportunities
• Incorrect or inappropriate AI responses to customers
• Service interruptions or data loss
• Damages arising from third-party AI service failures
MAXIMUM LIABILITY: Our total liability to you for any claims arising from use of AI 3000 PRO shall not exceed the total amount you paid us in the 12 months preceding the claim.
ESSENTIAL PURPOSE: These limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
10. Warranties & Disclaimers
DISCLAIMER OF WARRANTIES: AI 3000 PRO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of AI-generated responses
• Warranties that defects will be corrected
You acknowledge that AI technology has inherent limitations and may produce incorrect, inappropriate, or unexpected responses.
11. Indemnification
You agree to indemnify, defend, and hold harmless AI 3000 PRO, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
• Your use of the service
• Your violation of these terms
• Your violation of any laws or third-party rights
• Customer disputes arising from AI chatbot interactions
• Your store's products, services, or policies
12. Service Modifications & Termination
Our Right to Modify: We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.
Our Right to Terminate: We may suspend or terminate your access to AI 3000 PRO if:
• You violate these terms or Shopify's policies
• Your account shows signs of fraudulent or abusive activity
• You fail to pay subscription fees
• We discontinue the service entirely (with 60 days' notice)
Effect of Termination: Upon termination, your data will be deleted within 30 days and you will lose access to all service features.
13. Data Protection & GDPR
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. You are responsible for ensuring you have appropriate legal basis to share customer data with AI 3000 PRO and for providing necessary privacy notices to your customers.
14. Changes to Terms
We may update these Terms of Service at any time. Material changes will be communicated via:
• Email to your registered address
• Notification in the Shopify admin dashboard
• Update to the "Last updated" date at the top of this page
Continued use of the service after changes take effect constitutes acceptance of the updated terms. If you do not agree to changes, you must uninstall the app.
15. Governing Law & Dispute Resolution
Governing Law: These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution: Any disputes arising from these terms or use of the service shall be resolved through:
1. Good faith negotiations between the parties
2. If unresolved after 30 days, binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA)
3. Arbitration shall be conducted online or in Wilmington, Delaware in English
Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AI 3000 PRO regarding use of the service and supersede all prior agreements.
